Terms of Service

These Terms of Service (the "Terms") govern use of the Served mobile application (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance & eligibility

These Terms are a binding agreement between you and Served. You must be at least 17 years old (and, if under the age of majority where you live, have a parent or guardian's permission) to use the Service. By using the Service you confirm you meet these requirements, have the legal capacity to agree to these Terms, and that the information you provide is accurate. If you do not agree, do not use the Service.

2. Your account

You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms.

3. License to use the Service

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, reverse-engineer, scrape, resell, or build a competing service from it, or use it unlawfully.

4. Your content

You retain ownership of the content you post — ratings, reviews, photos, messages, event details, and profile information ("User Content"). You grant Served a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your User Content to operate, promote, and improve the Service. You represent that you have the rights to post your User Content and that it does not violate these Terms or any law.

5. Ratings, reviews & opinions

Served is a platform for people to share their personal experiences and opinions about venues, events, and nights out. Ratings and reviews reflect the individual, subjective views and personal experiences of the users who post them. They are not statements of fact by Served, and Served does not write, solicit, edit, endorse, verify, or adopt them. Served does not guarantee that any User Content is accurate, complete, or reliable, and any reliance you place on it is at your own risk. Venues, organizers, and others mentioned in User Content are responsible for their own conduct; opinions about them belong to the users who express them.

6. Served's role as a platform

Served is an interactive computer service that hosts content created by its users. Consistent with Section 230 of the U.S. Communications Decency Act (47 U.S.C. § 230) and similar laws, Served is not the publisher or speaker of User Content and is not responsible or liable for content created by users. Any dispute about User Content — including any claim that a review is false, defamatory, or harmful — is between the user who posted it and the person or business it concerns. You agree not to hold Served liable for User Content posted by others.

7. Community rules & objectionable content

Served has zero tolerance for objectionable content or abusive behavior. You agree not to post or do any of the following:

You are solely responsible for your User Content and for any consequences of posting it.

8. Reporting, moderation & takedown

Served provides tools to report content, block other users, and flag accounts. If you are a user, venue, or organizer who believes content is unlawful, infringing, or violates these Terms, you may report it to support@servedapp.us with enough detail for us to locate and review it. We review reports and may remove content or suspend accounts at our discretion. Choosing to remove — or not remove — content is a good-faith moderation decision and is not an admission of any fact or liability. We are not obligated to monitor User Content but may do so.

9. Tickets & payments

Some events are ticketed. Payments are processed by Stripe; the event organizer — not Served — is responsible for the event and for honoring tickets. Service and processing fees may apply and are non-refundable except as required by law. Refunds, where offered, are handled by the organizer according to their policy and applicable law. Chargebacks or fraudulent payment activity may result in account suspension.

10. Events & assumption of risk

Event details are provided by organizers and users. Served does not host, control, inspect, or guarantee any event and is not responsible for what happens before, during, or after one — including the conduct of organizers, venues, or other attendees, or the service of alcohol. You attend events at your own risk and are responsible for following all venue rules, local laws, and drinking-age requirements.

11. Disputes between users; release

The Service connects users, organizers, and venues. Served is not a party to and is not responsible for interactions or disputes between you and other users, organizers, or venues, including disputes arising from reviews, events, payments, or conduct. To the fullest extent permitted by law, you release Served and its officers, owners, employees, and agents from any claims, demands, and damages of every kind arising out of or connected with such disputes.

12. Intellectual property & copyright

The Service — including its name, logo, design, and software — is owned by Served and protected by intellectual-property laws. If you believe content on the Service infringes your copyright, send a notice to support@servedapp.us identifying the work, the infringing material and its location, your contact information, and a statement of your good-faith belief and the notice's accuracy. We respond to valid notices, including by removing infringing material and, where appropriate, terminating repeat infringers.

13. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Served does not warrant that the Service will be uninterrupted, secure, or error-free, or that any User Content is accurate or reliable.

14. Limitation of liability

To the fullest extent permitted by law, Served and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service, User Content, events, or interactions with others — even if advised of the possibility. To the fullest extent permitted by law, Served's total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid Served in the 12 months before the claim, or (b) US $100.

15. Indemnification

You agree to defend, indemnify, and hold harmless Served and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or any law; or (d) your violation of the rights of any third party, including any claim that your content is defamatory or otherwise unlawful.

16. Dispute resolution & arbitration

Please read this section carefully — it affects your legal rights. Except where prohibited by law, you and Served agree to resolve any dispute relating to these Terms or the Service through binding individual arbitration rather than in court, and on an individual basis only — class actions and representative actions are waived. Either party may still bring a qualifying claim in small-claims court. You may opt out of this arbitration agreement by emailing support@servedapp.us within 30 days of first accepting these Terms.

17. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Subject to the arbitration section above, any dispute will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

18. Termination

You may delete your account at any time from within the App. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or to protect the Service or its users. Sections that by their nature should survive termination — including content licenses already granted, disclaimers, limitation of liability, indemnification, release, and dispute resolution — survive.

19. Changes to these Terms

We may update these Terms from time to time. We will update the date at the top of this page and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
